The guards were meant to check the cell every so often, Sterling told the Times, and the crime would have taken hours to commit. If the guards had been doing their required checks, Romero would be alive today, he said.
Romero, who had spent 27 years in prison, was put in the cell with Osuna after arriving from Mule Creek State Prison, according to the lawsuit. He was convicted of second-degree murder after fatally shooting a woman in Compton when he was a teenager and associating with gang members. He was nearing parole eligibility.
His new cellmate, Osuna, was serving a life sentence for the killing and torture of Yvette Pena, 37, at a Bakersfield motel in 2011. With face tattoos and flair for Charles Manson-like satanic antics, he became a dark figure during the 2017 trial, mocking the victim’s family and bragging to a television news reporter of his love of torturing people.
Sometime in the early hours of March 9, 2019, Osuna methodically tortured and killed Romero, authorities said.
Using a razor-style blade attached to a handle, Osuna ultimately cut Romero’s head. He also posed the body, slicing Romero’s face open on either side of his mouth to resemble an extended smile, according to an autopsy.
Guards found Osuna wearing a necklace made of Romero’s body parts, the Times said.
Kings County Executive Assistant Dist. Atty. Phil Esbenshade called it the most heinous slaying he had ever seen. “We do believe that the victim was conscious during at least a portion of the time,” he said.
Osuna has been transferred to Salinas Valley State Prison’s psychiatric inpatient program. He has been diagnosed with unspecified schizophrenia spectrum, antisocial personality disorder and borderline personality disorder, according to the newspaper.
A judge has ruled that Osuna is not competent to stand trial for Romero’s death.

California killer accused of beheading, torturing cellmate

SACRAMENTO, Calif. (AP) — One convicted killer has been accused of beheading another in what authorities call an exceptionally sadistic torture slaying at a California prison.
Corcoran State Prison inmate Jaime Osuna removed several body parts from his cellmate, Luis Romero, Assistant Kings County District Attorney Phil Esbenshade said Friday. Charges accuse Osuna, 31, of repeatedly cutting Romero last month using what the prosecutor called a sharp metal object wrapped in string and attached to a handle.
It’s not clear how much happened while Romero, 44, was still alive or whether anyone heard the overnight assault, but “we do believe that the victim was conscious during at least a portion of the time,” Esbenshade said in an email. “This is the most gruesome case that I have seen in terms of heinousness in the slaying.”
The California Department of Corrections and Rehabilitation is conducting an internal investigation, spokeswoman Terry Thornton said. Officials wouldn’t provide more details on how prisoners are overseen overnight.
Osuna pleaded not guilty to murder and other charges at his first court appearance Thursday. They include several special circumstances that could bring the death penalty, including that the slaying “was especially heinous, atrocious, or cruel, manifesting exceptional depravity.”
Defense attorney Melina Benninghoff was appointed to represent him but was home sick Friday and did not respond to telephone and email requests to comment on his behalf.
Osuna also is charged with torture, mayhem and weapons possession. The torture charge alleges that he acted “with the intent to cause cruel and extreme pain and suffering for the purpose of revenge, extortion, persuasion and for a sadistic purpose.”
The state corrections department said guards found Romero dead in his cell about 7:30 a.m. March 9 at the prison, which houses more than 3,300 inmates about 220 miles (354 kilometers) south of Sacramento.
Romero bled to death from “multiple sharp force trauma injuries,” and his body was mutilated, according to an autopsy report released Friday.
Osuna was sentenced to life without parole after pleading guilty in 2017 to killing Yvette Pena, 37, at a Bakersfield motel in 2011, according to media reports at the time.
Romero also was serving a life term for a Los Angeles County slaying, but with the possibility of parole.
Osuna has been transferred to a Stockton prison for inmates needing medical or mental health care, though officials wouldn’t say why, citing privacy laws.

Murderer mocks victim's family as he's sentenced to life without parole

For Jaime Osuna, the man who tortured and killed Pena, it was one last chance to mock the family. He rolled his eyes and smirked as Pena's relatives addressed the court.
Osuna, 29, gave a thumbs-up sign as Judge John S. Somers sentenced him to life without parole. And he waved at Pena's relatives before deputies took him away.
Danielle Gonzales, Pena's younger sister, told the court there's no such thing as closure when someone you love dies in "such a tragic way." The pain she feels is the same as it was when she was first notified of the killing, she said.
"Five years, six months and two days later the hurt is still just as bad as the night I got that knock on my door," Gonzales said.
Osuna pleaded guilty in March to five charges including first-degree murder.
Pena's body was found Nov. 13, 2011, at the El Morocco Motel. Osuna was arrested five days later after officers surrounded an apartment he was staying at in the 400 block of Real Road.
Coroner's officials ruled Pena died of blunt force injuries, sharp-force injuries and asphyxia. Prosecutor Nicholas Lackie declined to go into the details of what he described as "truly horrific" injuries inflicted upon the victim.
Lackie said Osuna's behavior Monday was much the same at each earlier court hearing. He said Osuna appeared amused by the process and acted as if he enjoyed the attention.
"It's truly reprehensible," Lackie said.
The heavily tattooed Osuna, who goes by the nickname "Lokito," admitted in an interview with KBAK Channel 29 he was one of the last people with Pena, but denied killing her. He said the motel room was used for prostitution and to get high on methamphetamine.
Osuna claimed he knew the names of the other people who were with him and Pena the day she died, and would give those names in court. He never did, and Lackie said there is no information to take action regarding his allegations.
While rehabilitation is one of the purposes of prison, Osuna indicated he will not change.
Gonzales, during her comments to the court, said Osuna has smiled during the 12 court hearings she attended in the case. She said she hoped one day he would feel remorse.
Osuna immediately shook his head and repeatedly mouthed, "No."

Prosecutors confirmed that Osuna's cellmate, Luis Romero, was decapitated and suffered other dismemberment. His body was found March 9 in the cell he shared with Osuna at Corcoran State Prison.
